Maintenance agreement holders will receive priority over call-in customers in scheduling repair calls.
Repair workmanship is guaranteed for thirty (30) days from date of repair.
Dealer's liability for improper performance or failure to perform this service agreement shall be limited to the refunding of a portion or whole of the payments made by Purchaser for the maintenance service. In no event shall Dealer be liable for consequential damages of any nature whatsoever resulting from its failure to perform, or to properly perform this agreement.
The terms of this agreement can be canceled by either party on a thirty (30) day written notice, but subject to price revision , on any anniversary date after the sixty (60) day written notice.
Cancellation must be in writing and signed by the policy owner, refund will be prorated and a 20% processing fee will also be assessed
First routine preventive maintenance service done after year one on new unit.
Hold Harmless Disclaimer:
Action will not be held responsible for any damage to the HVAC, or plumbing system, including drain lines, or the structure and it's contents where the maintenance or service work is being performed and cannot be responsible for what may occur after completing the service or maintenance, particularly as it may pertain to clogged or blocked drain lines, and any water related issue.
Although care is taken to minimize mess it is not always unavoidable. There may be drips/splashes/splatters or flooding of dirty material in work areas while working or transporting equipment to the work area, particularly when cleaning drain lines.
By signing this agreement you release Action Cooling and Heating from all liability for any damage as a result of a blocked drain line.
Parts And Labor Warranty Exclusion:
Ductwork, rust, maintenance related problems, acts of God, and parts outside of the air conditioning cabinet.

BUYER'S RIGHT TO CANCEL APPLICABLE PURSUANT TO FLORIDA STATUTE 501.031: "If this is a home solicitation sale, and if you do not want the goods or services, you may cancel this agreement by providing written notice to the seller in person, by telegram, or by mail. This notice must indicate that you do not want the goods or services and must be delivered or postmarked before midnight of the third business day after you sign this agreement. If you cancel this agreement, the seller may not keep all or any part of any cash down payment."
